PrimeWorks Software Solutions Pty Ltd ACN 153 254 801 (PrimeWorks) recognises the importance of protecting the privacy of personal information collected from our customers. Primeworks is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) in relation to the handling of personal information. The APPs regulate the manner in which personal information is handled, from collection to use and disclosure, storage, accessibility and disposal.

PrimeWorks is a boutique computer software house which provides leading software to the bus and coach industry. Primeworks is committed to protecting the privacy of the personal information it collects and uses.

This Privacy Policy aims to inform you of the type(s) of information collected by PrimeWorks, the purpose for which that information is collected and how it is used in providing services to our customers and any other ancillary uses, how it is disclosed to third parties and how the information is destroyed. This Privacy Policy also seeks to explain how you can ask to access and correct the personal information we hold about you or complain about any suspected privacy breach.

For the purpose of this Privacy Policy, the word 'customers' includes visitors to our website, subscribers to our website and users of our services.

What is personal information?

Personal Information is information about an individual who is either identified or reasonable identifiable and includes an individual's name, address, contact number and email address.

The kinds of personal information we collect and hold

PrimeWorks collects and holds the following personal information from its customers including personal information of passengers and the employees of our customers:

  • Surname
  • Phone number
  • Residential address
  • Email address

How does PrimeWorks collect, hold, use and disclose personal information?

PrimeWorks collects, holds, uses and discloses personal information in order to be able to provide our goods and services to its customers, including creating user accounts and managing the user accounts of its customers, allowing customers to access their own account to enter employee and customers information.

PrimeWorks also use the personal information it collects for the purpose of troubleshooting and providing support services to its customers.

PrimeWorks may collect information under the direction of its customers, and may have no direct relationship with the individuals whose personal data it processes, for example PrimeWorks may collect data from customers including, but not limited to, customer employee data and customer student-passenger data.

PrimeWorks may automatically collect personal information by collecting and tracking the unique device identifier or the universally unique identifier of the devices you use to access our services.

When you are online, we may collect information regarding the Web pages within our network which you visit and what links you click on.

PrimeWorks may use personally identifiable information to improve our goods and services including creating more responsive websites which meet the needs of our customers. This statistical compilation and analysis of information may also be used by PrimeWorks for research purposes.

We may also collect, hold, use and disclose personal information for other purposes which will be explained to the customer at the time of collection or which are required or authorised by or under law or for which the individual has provided their consent.

Sensitive information

Sensitive information is personal information which is granted a higher level of privacy protection under the APPs. Sensitive information includes health and genetic information and information about racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record and some types of biometric information.

PrimeWorks may collect sensitive information for the purposes of providing our goods and services to you. Any sensitive information collected will be handled by PrimeWorks in accordance with the APPs.

Use of non-personal information

We may collect and use certain non-personal information (e.g., the identity of your Internet browser, the type of operating system you use, your IP address and the domain name of your Internet service provider) to optimise our goods and services including our Web pages for your computer. We may use such non-personal information for internal purposes, including but not limited to improving the content of our websites.

Direct marketing

Currently PrimeWorks does not use its customers information for the purpose of direct marketing. Under Australian law, we are not permitted to do so unless we have your consent.

Where you have consented to receiving direct marketing communications from us, your consent will remain current until you advise us otherwise. You can, at no cost, opt out at any time, by contacting us at admin@primeworks.com.au or by writing to us at the address provided below.

Cookies

Cookies are data that a website transfers to an individual's hard drive for record-keeping purposes. Cookies can facilitate a user's ongoing access to and use of a website. They allow us to track usage patterns and compile data that can help improve our content and target advertising.

What if you don't want to provide your personal information to us?

The APPs require PrimeWorks to provides its customers with the option of using a pseudonym where is it lawful or practical to do so. Given the nature of the information PrimeWorks requires its customers provide, it would not be practical to allow the customer to use a pseudonym or to allow the customer to de-identify themselves.

How we collect and hold personal information

Methods of collection

PrimeWorks is required by law to only collect personal information by lawful and fair means.

We collect personal information in a number of ways, including:

  • via USB
  • direct file transfer or FTP upon pre-arranged approval or with the consent of the customer
  • direct http/s files uploaded to the website by customers
  • by email
  • over the telephone
  • through written correspondence (such as letters, faxes and emails)
  • on hard copy forms
  • in person
  • through our website (for example, if you make an online purchase or complete and submit a form online)
  • from third parties, including:
    • direct marketing database providers
    • the ATO or ASIC
    • public sources, such as telephone directories, professional and trade associations, ASIC searches, bankruptcy searches and searches of court registries

Unsolicited information

Unsolicited personal information is personal information we receive that we have taken no active steps to collect. If PrimeWorks receives unsolicited personal information that could have been collected from you in accordance with the Privacy Act, we will afford it the same privacy protection as if we had solicited this personal information.

If the information is not reasonably necessary for one or more of PrimeWorks functions or if the information could not have been collected in accordance with the Privacy Act, we will destroy or de-identify the information as soon as practicable, provided it is lawful and reasonable to do so.

Disclosure of personal information to third parties

PrimeWorks may provide access to electronic interfaces to and from Transport for New South Wales (TfNSW) which may be used to share or collect personal information on a customer's behalf. These electronic interfaces are managed by TfNSW and require approval and activation from TfNSW.

Cross border disclosure of personal information

If information is to be shared with international entities, PrimeWorks policy is to comply with the requirements of the Privacy Act that apply to cross border disclosures of personal information, as well as with any legal requirements applicable in the relevant jurisdiction.

Data quality and security

PrimeWorks strives to ensure the security, integrity and privacy of personally identifiable information. We use a variety of physical and electronic security measures including restricting physical access to our data centre and firewalls and secure databases to keep personal information secure from misuse, loss or unauthorised use or disclosure. If you are a subscribing customer then your data will be kept in a separate database from other customers.

Our website and its services use a secure communications protocol in the form of Hypertext Transfer Protocol Secure (HTTPS). Unfortunately however, no data transmission over the internet can be guaranteed to be totally secure.

PrimeWorks will take reasonable steps to:

  • make sure that personal information we collect, use and disclose is accurate, up to date and complete and (in the case of use and disclosure) relevant; and
  • protect the personal information that we hold from misuse, interference and loss and from unauthorised access, modification or disclosure

General security and use of the Internet

Ultimately, you are solely responsible for maintaining the secrecy of your username and passwords and any account information. Please be careful and responsible whenever you are using the internet.

It is important to log out and close your browser when you have finished your user session. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet caf�. You as an individual are responsible for the security of and access to your own computer.

PrimeWorks may establish relationships with business partners that allow visitors or customers to our website to link directly to websites operated by these partners. These websites may not be operated or maintained by or on our behalf. These websites may also collect personal information from you that may be shared with us. This Privacy Policy will apply to any personal information we obtain in this manner.

The following is a list of third parties who share information with PrimeWorks. Please note that this list may be updated from time to time:

  1. https://appln.transport.nsw.gov.au/mapservices/proxy/radialCheck/map.html (STREAT).PrimeWorks receives data from this site however does not send any data to it
  2. https://six.nsw.gov.au/wps/portal/ (NSW Spatial Information Exchange or SIX). PrimeWorks send non-personally identifiable data to this site (latitude and longitude) data.
  3. apis.google.com and other Google subdomains. PrimeWorks uses or references Google apis for integration with Google maps api and may expand this to other Google api's.
  4. http://www.microsoft.com/en-us/download/details.aspx?id=6116 (Microsoft SQL Server 2008 R2 Report Builder 3.0). This website is directly hyperlinked on the PrimeWorks website.

PrimeWorks is not responsible for the content or practices of websites operated by third parties that are linked to our websites. These links are meant for the user's convenience only. Links to third party websites do not constitute sponsorship, endorsement or approval by PrimeWorks of the content, policies or practices of those third party websites. Once you have left our website via such a link, we encourage you to check the applicable privacy policy of the third party website before providing any personal information.

Access and correction of your personal information

You have the right to request access to or correction of the personal information that PrimeWorks holds about you.

PrimeWorks shall provide you with access to your personal information, subject to some exceptions permitted by law. We may provide access in the format that you have requested provided it is reasonable and practicable for us to do so.

You may request that PrimeWorks access and correct your information to ensure that is it up-to-date, relevant, complete and accurate. If PrimeWorks becomes aware of an inaccuracy in relation to your personal information PrimeWorks will take reasonable steps to correct that information.

Complaints

PrimeWorks Software Solutions welcomes your comments regarding this Privacy Policy. If you have any queries or complaints in relation to PrimeWorks' handling of your personal information or compliance with the APPs, please contact the Privacy Officer in writing at the following address:

If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner.

Retention of personal information

All personal information that has been collected from you will only be kept for a duration that is relevant to the purpose for which your personal information is to be used and for as long as required by applicable law.

If personal information is no longer required or is unlawful to be held by PrimeWorks it will be destroyed accordingly.

Changes to this policy

We may vary this Privacy Policy from time to time. The most current Privacy Policy will appear on our website. Alternatively, a copy can be requested from our Privacy Officer.
